So why do I suspect he may be gay? Well, he says if I tell any of his friends, he'll kill me. I even suggested that he might be bisexual, which he says it isn't the case, and that we denied this situation ever happening. On the other hand, he also says no one will believe me anyways. In any event, I probably find him to be a heterosexual, just for the fact of weighing out the opposites.
The problem is, I am over 18.0, and he is under 18.0, making him a minor. Not only that, he is under 14, making this a super-felony. But what laws would the following have been committed as?
I see the 2 main events as.
1.Rubbing penis.
2.Penis in mouth.
Number 2 is invalid for me, because, I did not put my penis in his mouth (so I did not commit that crime).
In any event, penal code 288 is once again lewd acts on child. I pasted penal code 288 in the police page, so I don't need to repaste it here.
288a. (a) Oral copulation is the act of copulating the mouth of one person with the sexual organ or anus of another person.
"Copulating in the mouth." Copulation is a synonym for sex by my definition. Sex I define to be the penis entering the vagina, so I do not know how it is possible between a penis entering a mouth.
Ejaculation? That did not happen.
Well, since I didn't put my penis in his mouth, we can ignore 288a.
(b) (1) Except as provided in Section 288, any person who participates in an act of oral copulation with another person who is under 18 years of age shall be punished by imprisonment in the state prison, or in a county jail for a period of not more than one year.
(2) Except as provided in Section 288, any person over the age of 21 years who participates in an act of oral copulation with another person who is under 16 years of age is guilty of a felony.
(c) (1) Any person who participates in an act of oral copulation with another person who is under 14 years of age and more than 10 years younger than he or she shall be punished by imprisonment in the state prison for three, six, or eight years.
What is interesting is the words "any person who participates." Does that imply to both the person who put the penis in the mouth and the person who received the penis in the mouth? If both, then, me being the receiver would have participated.
Rubbing penis? I don't know what that is, specifically, but I could probably list several laws that can apply to that act.
The situation with the laws.
The laws did not specify what gender the "child" had to be. It did not say whether it applies to girls only or boys only. By conversion, that could mean it doesn't matter whether the 13 year old was male or female. So, logically, if I plugged the child in as a variable on being female, then logically, my penalty would be the same.
This equal-gender opportunity scenario goes as follows: that a 13-year old girl could ask me to rub her penis, or for her to put her penis in my mouth, and for me to rub her penis. If that were the case, do I think I will go to prison? And if so, if this was instead a boy, would it have made any difference?
Well, luckily, girls generally do not have penises, and, since this is the case with a 13-year old black boy, I don't even have to think about the hypothetical situations!
Can I get in trouble for the above incident?
Innocent until proven guilty. Apparently, the law isn't so much about "the truth" as much as what you can prove. And the case being, that this 13 year-old will most likely deny the situation ever happening. He probably wouldn't want his family and friends to know of that situation, obviously. He may very well realize he can get a clear shot of locking me up in prison, and, well, I apparently know how to get him back in juvenile hall too, so, the [3] of us, can all get locked up!
Either way, none of this was my idea. I was just doing as I was told! I have no idea if that is in accordance with the law..
As far as getting, 'easily' the 2 of them in jail, that's not likely going to happen. Because 1 of them I like, and the other 1, I not so much like. Think about it as, would you rather get a friend and enemy in jail, or not get a friend and enemy in jail? That's basically what I have to decide, and knowing me, I believe in giving people the benefit of the doubt. Therefore, I would not want to get the person I like in jail.

There is 1 thing that can lead to getting the person I don't like in jail, the one who put his cockhead in my mouth, and, it is for the image below that describes it.
Getting punched near the eye on the way to North County Fair, oh well, the heat is over, as I treated the 2 of them to a full meal at McDonalds.
But the above cannot happen, as I would have to prove that he punched me near the eye, and I would have to prove that the image of me is the result of him punching me near the eye, and, that can't happen, as I didn't video tape him punching me in the face twice.
As far as beating him up, hitting a 13 year old boy would not be good, for my age of 19, as this is definitely not self-defense.
